Steven Frane Bailey who is facing over a dozen charges, including two counts of third-degree murder, related to the deadly Park Tavern crash on Labor Day weekend has been granted conditional release from jail.
According to a document filed in the case on Tuesday, Hennepin County District Court Judge Juan Hoyos signed the order which requires Bailey, 56, to comply with a number of conditions including transfer on Oct. 14 directly to a treatment facility. Bailey must also be subject to electronic home and alcohol monitoring and random drug and alcohol testing, and he will not be allowed to drive.
Two people were killed, and at least nine others were injured on Sunday, Sept. 1 when Bailey plowed his vehicle into the outdoor patio at the bar in St. Louis Park. The crash, which was captured on surveillance video, killed Park Tavern server Kristina Folkerts, and Methodist hospital worker Gabe Harvey, both age 30.

Bailey’s BAC returned a reading of .325 following the crash, which is four times the legal limit to drive in Minnesota. He was initially charged with criminal vehicular homicide and operation in the case, but the charges were later amended to include the third-degree murder charges.
A person commits third-degree murder when they cause death “by perpetrating an act eminently dangerous to others and evincing a depraved mind, without regard for human life,” the Hennepin County Attorney’s Office said in a statement accompanying the upgraded charges at the time.
Court documents indicate that Bailey has already posted a $500,000 bond, and the jail record indicates that he remains in custody at this time.
Information was not immediately available on how long Bailey is expected to remain at the treatment facility before being transferred to electronic home monitoring.
