
(Daily Caller News Foundation) — A jury awarded a young woman $2 million after finding two medical professionals liable for malpractice in connection with a sex change procedure performed on her when she was a minor.

Fox Varian, 22, sued both a psychologist and plastic surgeon involved in carrying out a double mastectomy on her in Westchester County, N.Y., in 2019, when she was a transgender-identifying 16-year-old. Varian, who now works as an actress and no longer considers herself to be transgender, is the first known “detransitioner” to win a civil medical malpractice trial, let alone take such a case to trial, multiple outlets reported.
The $2 million jurors awarded the woman includes $1.6 million for the suffering she endured as a result of the procedure and an additional $400,000 to cover her future medical expenses, The Epoch Times reported. Varian’s attorney had asked for $8 million, a significantly larger amount in total damages, according to the outlet.
The case, Varian v. Einhorn, was filed in New York Supreme Court in Westchester County, according to a screenshot shared by independent journalist Benjamin Ryan. It lists Varian as the sole plaintiff. New York-based clinical psychologist Kenneth Einhorn and New York-based plastic surgeon Simon H. Chin, as well as their respective employers, were listed as the plaintiffs, the screenshot shows.
Ryan, who is known for his reporting on pediatric gender medicine, stated in a Substack post late Friday he was “the only reporter to attend the entire 3-week, historic trial,” which he called “riveting” yet “sparsely attended.”

“I have identified 28 detransitioner lawsuits filed to date,” the journalist wrote in a post to X early Saturday morning. “Varian v. Einhorn was the first to go to trial and the first to win a judgment, making history.”
The jury had concluded Einhorn and Chin’s conduct leading up to Varian’s double mastectomy marked a “departure from the standard of care,” the Epoch Times reported. The verdict only specifically applied to the plaintiff’s case, however, and not in general to minors receiving so-called “gender-affirming” care, National Review reported.
Chris “Billboard Chris” Elston, an activist known for his opposition to child sex changes, hailed the verdict of Varian’s case in a late Friday social media post.

“This verdict, is, I hope, a really significant step in turning around this madness,” Republican Texas Sen. Ted Cruz said during an episode of his podcast, “Verdict with Ted Cruz,” that aired Monday.
“This is not going to be the last lawsuit and you pointed out one of the most evil aspects of this, which is there is a multi-million dollar, if not a multi-billion dollar, industry behind this, behind pushing these supposed treatments that are just abusing kids. And you’ve got woke adults that are pushing these treatments because they want to virtue signal just how virtuous they are. But you’ve also got hospitals,” Cruz said. “You’ve got doctors that are making massive amounts of money and this lawsuit, you want to talk about changing physician behavior and changing hospital behavior, this lawsuit is significant.”
