Shelby Gene Boswell, 29, has received a 110-month prison sentence followed by three years of probation for firing a gun within a school zone, the U.S. attorney for Minnesota announced this week.
On October 18, 2019, Boswell opened fire during his grandmother’s funeral service, shooting Broderick Boshay Robinson in the back of the head with a rifle. Robinson has been identified as the boyfriend of Boswell’s sister. Robinson survived the attack and was treated at Essentia Health-St. Mary’s Medical Center in Duluth.
The Fond du Lac man was originally charged with one count of second-degree assault with a dangerous weapon, fifth-degree methamphetamine possession, firearm violation, introducing contraband into jail, first-degree great bodily harm, and third-degree possession of heroin.
The shooting occurred in the Fond du Lac reservation near Duluth, Minnesota. Boswell also discharged his firearm within 1,000 feet of Fond du Lac Ojibwe High School, which was placed on lockdown as a result of the shooting.
Boswell was arrested in the parking lot of the Fond du Lac Head Start building, where the funeral took place. He was in possession of 3.5 grams of heroin, methamphetamine, and marijuana, which Carlton County Jail staff recovered after Boswell was booked.
Before the incident, Boswell had prior felony convictions prohibiting him from owning a firearm or ammunition. Court records indicate that Boswell has multiple felony assault convictions dating back to 2010. Boswell’s convictions are in Beltrami County and Carlton County.
